A Public Hearing and Regular Meeting of the Black Point Beach Club Zoning Board of Appeals was held on Friday evening, May 26, 2006 at 7:00 PM at the Black Point Beach Club Association Clubhouse located at the corner of Woodland and Sunset Streets in Niantic, CT.
PRESENT: Peter Stempien, Chairman, Sally Cini, Secretary, Phil Hagaman, Bill Greenwood, Steve Whitman, Alternate
ALSO PRESENT: Todd Peretz, Applicant, Bill Willetts, Alternate, Charlie Beckham, Black Point Beach Association ZEO
ABSENT: Don Wilkinson, Tom Hayes, Alternate
1. Call Public Hearing to Order
Chairman Stempien called the Public Hearing to order at 7:05 PM.
Mr. Stempien noted that he had seated Steve Whitman, Alternate at the table.
2. Read Notice of Public Hearing
Mr. Stempien asked that they swap the order of the applications this evening as Mr. Peretz had a family situation to attend to. He then asked Ms. Cini, Secretary to read the Notice of Public Hearing:
Case No. 3 - 2006: Request for variance in Section V (dimensions) by Todd and Denise Peretz for a house on property located at 4 Sunrise Ave.
Mr. Stempien noted that this notice was sent to The Day for publication.
3. Introduction of Zoning Board of Appeals members
Mr. Stempien asked the Board Members to identify themselves for the audience. The members did so.
4. Poll ZBA Members for conflicts of interest
Mr. Stempien polled the Board members for any conflicts of interest hearing none he noted to the applicant and the audience that they would need four votes in favor for the appeal to be granted.
Mr. Stempien then asked the applicant to present his case.
Todd Peretz, 4 Sunrise Ave. said that he is the owner and applicant. The house that he purchased and that they live in at this address is a one-story ranch with a crawl space underneath. They are looking to demolish it and excavate for a full foundation and put in a modular one-story ranch with an attached garage. There is a small porch on the front of the house now that extends out about six feet and rather than keeping the porch, they want to extend the entire width of the new house by six feet. He said that they are looking for a six foot setback variance on the Sunrise St. side from the current setback of 20’9” to a new setback of 15’8”. The new house would not have a porch but it would have an attached garage.
Mr. Stempien asked if he could move the house six feet to the back.
Mr. Peretz said that if they did move it six feet to the back that they would probably fall into the neighbors’ property. The lot slopes and there is a retaining wall between the two lots.
Mr. Stempien asked Mr. Peretz if he has spoken with his neighbors about this and if they have any concerns.
Mr. Peretz said that he has spoken with his neighbors and that he has a good relationship with them and that he hopes to rent their place while his home is being replaced so that he can be present for the work.
Mr. Whitman asked if he understood correctly that there is a small deck in front of the house currently and what Mr. Peretz would like to do is to have the entire length of the house come up to where the deck currently ends in front.
Mr. Peretz said that was correct and added that there would not be a deck on the new house.
Mr. Hagaman asked if he was looking to just extend the porch area from one side to the other of the house.
Mr. Peretz said that was correct.
Ms. Cini asked if they wanted this size modular home because that is the size that it comes in.
Mr. Peretz said yes. He added that they have larger ones however they could not fit them here.
Mr. Stempien asked Mr. Beckham, BP ZEO if he had any issues with this.
Mr. Beckham said, not that he could see right now although there may be some concern with the retaining wall once construction starts.
Mr. Peretz said that he owns two feet beyond the retaining wall and that he expects to replace it with a much better looking one.
Mr. Stempien asked if there were any other questions or comments regarding this application

Mr. Stempien closed this public hearing at 7:15 PM.
REGULAR MEETING
Mr. Stempien opened the Regular Meeting for Case No. 3-2006 at 7:15 PM.
Case No. 3 - 2006: Request for variance in Section V (dimensions) by Todd and Denise Peretz for a house on property located at 4 Sunrise Ave.
Mr. Stempien called for a motion for discussion.
**MOTION (1)
Mr. Hagaman moved to Approve the request for variance in Section V (dimensions) of Todd and Denise Peretz for a house on property located at 4 Sunrise Ave., per the drawing submitted, (attached) into the setback to extend the house to meet the current porch placement due to the back of the lot dropping off on a slope to the neighbors’ property.
Mr. Greenwood seconded the motion.
Mr. Stempien called for discussion.
Hearing none
Mr. Stempien called for a vote on the motion.
Vote in Favor of the motion: 5 0 0. Motion passed.
ADJOURNMENT

Mr. Hagaman moved to adjourn Case 3-2006, May 26, 2006 meeting of the Black Point Beach Club Zoning Board of Appeals at 7:20 PM.
Mr. Greenwood seconded the motion.
Vote: 5 0 0. Motion passed.
